“We”, “our” refer to Martha SRLS. “You”, “user” refer to anyone visiting the site, registering for a course or event, or making a purchase through the cart.

2. Acceptance of terms

By visiting the site, registering for a course, masterclass, workshop, event, or making a purchase through the cart, you fully accept these Terms and Conditions. If you do not accept them, please refrain from using the site or its services. You confirm you are at least 18 years old, or acting with the consent of your parent/legal guardian.

3. Services offered

Martha offers, among others: annual advanced music training courses, masterclasses and workshops, house concerts, teacher training, seminars, venue and studio room rental, recording studio services, artist residencies, corporate services, and the “Become a Patron” program. Purchases through the site’s cart primarily concern tickets and registrations for events, masterclasses and courses with specific dates or periods.

4. Registrations and online purchases

Registrations and purchases are finalized upon the order confirmation sent by email after payment. Prices are in Euro, VAT included where applicable. We reserve the right to refuse or cancel an order in case of unavailability, an evident pricing error, or suspected fraud, and will notify you accordingly.

5. Right of withdrawal

If you are a consumer, you generally have the right to withdraw from a contract concluded online within 14 days, without giving reasons, pursuant to Articles 52-58 of the Italian Consumer Code (Legislative Decree 206/2005).

In practice, nearly all purchases made on the site (tickets for house concerts, registrations for masterclasses, workshops, courses and events with specific dates or periods) are excluded from the right of withdrawal pursuant to Art. 59, paragraph 1, letter n) of the Consumer Code, which excludes withdrawal for “services related to leisure activities where the contract provides for a specific date or period of performance.” This exclusion applies automatically due to the nature of the service purchased and is disclosed to you at the time of purchase.

For any residual case of services without a specific date or period, the right of withdrawal also does not apply, pursuant to Art. 59, paragraph 1, letter a), to service contracts after full performance, where you gave prior express consent to begin performance before the 14-day period expires and acknowledged the loss of the right of withdrawal upon full performance.

Donations made under the “Become a Patron” program generally do not constitute a purchase of goods or services subject to withdrawal, unless they involve a specific benefit in return for the donor.

Where the right of withdrawal applies, you may exercise it by sending a written notice to info@marthapalermo.it, optionally using the model form in Appendix A. Refunds will be issued within 14 days of receiving the withdrawal notice, using the same payment method used for the purchase.

6. Payment methods

Payments are processed via Stripe, PayPal, Satispay and Nexi. Martha does not store payment card data, which is handled exclusively by these providers under PCI-DSS security standards.

7. Cancellations, changes and refunds

If Martha cancels a course, masterclass or event (e.g. insufficient enrollment or force majeure), the participant will be offered a full refund or, where possible, participation in a future edition. Cancellation requests should be sent to info@marthapalermo.it.

8. User obligations

By using the site or services, you agree to: provide truthful, complete and up-to-date information; not use the site for unlawful purposes; not distribute viruses, malware or harmful code; not reproduce or commercially exploit site content without written authorization; comply with conduct rules during in-person courses, masterclasses and events.

9. Intellectual property

All site content (text, images, logos, videos, teaching material) is owned by Martha SRLS or its licensors and protected by copyright law. Reproduction without prior written authorization is prohibited.

10. Authorization to use images

With reference to photographs and videos taken by Martha SRLS at its premises and on its digital channels (including live streaming) during courses, masterclasses, house concerts and events, the participant/purchaser authorizes, free of charge, pursuant to Art. 10 of the Italian Civil Code and Articles 96-97 of Law No. 633/1941 (Copyright Law), the publication and distribution of their image on www.marthapalermo.it, on Martha’s social media profiles, in print materials and other media, for informational and promotional purposes, as well as retention of the material in Martha’s archives. This authorization may be withdrawn at any time by writing to info@marthapalermo.it, without affecting material already lawfully published. For minors, authorization must be given by the person exercising parental responsibility, pursuant to Art. 320 of the Italian Civil Code.

11. Third-party links

The site may contain links to third-party websites over which Martha has no control and for which it assumes no responsibility. Visiting such sites is at your own risk, subject to their own terms and conditions.

12. Limitation of liability

To the extent permitted by applicable law, Martha is not liable for indirect damages arising from use of the site or services. Nothing in these Terms excludes or limits Martha’s liability for willful misconduct or gross negligence, for death or personal injury caused by negligence, or for any other liability that cannot be excluded or limited under Italian law, including Articles 1229 of the Civil Code and 33-36 of the Consumer Code.

13. Governing law and jurisdiction

These Terms and Conditions are governed by Italian law. For consumers, the competent court is that of the consumer’s place of residence or domicile, pursuant to Art. 33, para. 2, letter u) of the Consumer Code. For business-to-business relationships, the exclusive competent court is that of Palermo.

14. Complaints and dispute resolution

For any complaint, contact us at info@marthapalermo.it or martha@pec.cgn.it. EU consumers may also use the European Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr, pursuant to Regulation (EU) No. 524/2013.

15. Changes to these Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be published on this page with the revision date indicated. Continued use of the site after changes are published constitutes acceptance of those changes.
